We reserve the right to immediately remove your access to our Site, products and/or Content, without refund, if you are found to be violating these Terms.

LINKS TO OTHER WEBSITES

Our Site and social media channels may have links to other sites operated by third parties. Unless we expressly tell you otherwise, we do not in any way, endorse, control or approve of and nor are we responsible for the content on those websites. It’s up to you to decide if those websites and their content are suitable for you.

PRICES AND PAYMENT

Prices on our Site may be set to different currencies depending on your country or region.

If shopping from within Australia all prices in Australian Dollars (AUD) are inclusive of any Australian Goods Tax (GST) as applicable. The prices indicated on our Site may change at any time without advance notice to you. The amount charged to you will be the price in force at the time your order is validated.

We reserve the right at any time to modify or discontinue any product without notice. We shall not be liable to you, or to a third party for any modification, price change, suspension or discontinuance of any product.

We reserve the right to cancel an order and provide a full refund in the event that a product has been discontinued or we do not have the stock available.

At this time, payment is accepted by credit or debit card as well as through third party financial services including PayPal & AfterPay. Where you use a credit card, you warrant that you have the necessary rights and authority to use that credit card. You authorise us to automatically charge the credit card on file for any and all payment balances owed and agree to keep all billing information current at all times. Where you fail to make payment or payment is declined for any reason, we may revoke your access to the products.

We reserve the right to cancel any order where we suspect that there is fraud or other types of illegal or unauthorised activity.

PRICING ERRORS

We reserve the right to amend any pricing errors displayed due to human error, computer malfunction or any other reason.

GIFT VOUCHERS 

You can purchase gift vouchers from our website. Our gift voucher policy is as follows:

• Our gift vouchers are valid for a period of 3 years from the purchase date;
• Our gift vouchers can be used for making a purchase from our AU Website;
• Only one gift voucher can be used at a time;
• Gift vouchers are non-transferrable and not redeemable for cash;
• Gift vouchers cannot be reloaded or topped up;
• If the total amount of the gift voucher is not used in one transaction, then the remaining balance can be used in another transaction.
• You cannot resell our gift vouchers.
• Gift vouchers cannot be used to purchase other gift vouchers
• No post supply fees are charged on gift vouchers; and
• We do not offer exchanges for unwanted vouchers and neither do we redeem them for cash.

TAXES AND DUTIES

Any international orders shipping to destinations outside of Australia may incur additional taxes, fees and duties, as required by the country of destination.

The responsibility for any customs duties, taxes or additional charges and import fees which may be imposed upon these consignments rests solely with the customer.

Import thresholds and customs charges are determined by your destination, the contents of your order and total value of your consignment. You may be required to pay these charges prior to receiving your order, or they may be charged to you at a later date. Fees of this nature, including any associated customs brokerage costs, are the responsibility of the receiver, and Softedge Studio will not be liable for the payment of such charges under any circumstances.

Please get in touch with your local customs office to find out if your order will incur any import fees prior to completing your online purchase.

If a consignment is determined to be undeliverable at destination due to refusal to pay the import fees mandated by local customs, multiple failed delivery attempts, or otherwise, the consignment will be abandoned at destination.

In the event of a redirection back to the sender due to situations aforementioned, any additional shipping costs and import fees required for the return to sender will be charged to the receiver. Any refunds issued in association with such redirections will be made less any freight on export, freight on import, customs taxes, duties, fees and charges.

Before placing your online order, we recommend contacting the customs office of the country of destination for advice regarding local import regulations.

AFTERPAY

If you hold an Afterpay account, you are able to use your account to make a purchase with us. Afterpay allows you to pay for your purchase over 4 equal instalments due at fortnightly intervals.

By using an Afterpay account with us, you agree that you are 18 years of age and are the authorised holder of the debit/credit card used in the purchase. 

All orders are subject to Afterpay’s approval. If you have any overdue payments, Afterpay will not be available. Afterpay will automatically try to process payments on the scheduled dates from your card. If a payment is not processed on or before the due date, late fees will apply.

RETURNS, EXCHANGES  DAMAGES POLICY

We offer change-of-mind exchanges for all items purchased at full retail price from on our Site.

Discounted items or purchases made as part of promotional sales are final and not eligible to be exchanged. 

In order to meet our exchange policy, items must be returned in their original unused condition with their original packing and received by our warehouse team within 10 days of the original delivery date.  

Softedge Studio is not responsible for any shipping costs associated with the exchange process. Items must be returned to our warehouse before a replacement can be dispatched or a credit note issued. Any variation in product price or additional shipping fees incurred due to change of mind must be paid in full before the exchange is completed and shipped.

We recommend sending returns using a traceable & insured service, as Softedge Studio is not responsible for any items lost or damaged during shipping. 

Softedge Studio reserves the right to reject any items that are returned in used, damaged, or otherwise unoriginal condition, where the sender is not able to provide proof of purchase or items have been returned outside of our policy period. Rejected items may be sent back to a nominated address at an additional cost.

DAMAGED & FAULTY GOODS

If your item/s arrives damaged, broken or faulty, please do not send us the damaged, broken or faulty item.

Please email us at orders@softedge.studio or fill out our contact form in order to inform us about damaged Goods within 48 hours of delivery. We request you to send us photos of the damaged Goods showing the damage / breakage as well as the exterior of the shipping carton with the label visible when you contact us.

SHIPPING

Your orders will be packed and dispatched within 5 business days of payment confirmation. This timeframe may be subject to change during peak sales periods or for larger scale orders. 

Shipping time will vary depending on the type of shipping method chosen at checkout, and destination region. At this time deliveries within Australia are carried by AusPost and international shipments with DHL express. 

Due to ongoing disruptions, we cannot guarantee the shipping timeframes for domestic or international shipments. 

Delivery timeframes specified on our General Info page are indicative, We are not in control of any shipping delays or transit issues which may occur once the consignment is in the hands of the courier.

HANDMADE GOODS DISCLAIMER

We do our best to ensure that the colours and finishes of all products are accurately displayed on our Site. Please note that the colours of products may vary in appearance to the actual colours depending on the device you use to view them. Due to the nature of handmade ceramics, there will always be some difference and variation in the colours, finish and form from one piece to the next. These variations are considered “normal” and do not deem the product to be faulty. If you are concerned about the appearance or use of a product you have received, please refer to our Handmade Distinctions or contact us at online@softedge.studio.

WARRANTIES

We warrant that the Goods we deliver will:

(a) match the description on the Website;
(b) be free of third party claims;
(c) fit for the purpose for which they are advertised; and
(d) be of acceptable quality.

LIMITATION OF LIABILITY 

Our Goods are designed for daily use and to last longer when used with care.

All online orders come with a care guide. The care guide can also be found on our website at: https://softedge.studio/care-guide/. Please ensure you carefully and thoroughly read all care instructions and care guides associated with your Goods in order to prolong the life of the Goods.

We do not claim any liability if you fail to care for the Goods correctly. If the Goods are damaged because of your recklessness or negligence, then we will be under no obligation to replace or repair them or to provide you with a refund.

To the fullest extent permitted by law, and notwithstanding any other provisions of this Agreement, our aggregate liability under or in connection with these Terms, however arising (including by reason of tort, negligence, breach of contract or otherwise), shall not exceed the sum of all fees paid to us in respect of the relevant Goods giving rise to the liability.

SUBMITTING CONTENT TO SOCIAL MEDIA

We always appreciate interaction on our social media channels and feedback about our Site and products.

Where you do decide to submit such feedback, comments or content, you represent and warrant that:

• you are the sole author and owner of the intellectual property and any other rights in that content (or have the right to use that content with appropriate consents and permissions);
• give us permission to post or otherwise use that feedback on our social media or other channel;
• you waive any and all existing and future moral rights (as defined in the Copyright Act 1968 (Cth)) in the content you provide us with;
• the content does not violate these Terms; and

We reserve the right to remove a review or comment if such review or comment contains

• libellous or otherwise unlawful, abusive or obscene material;
• attacks our employees or another contributor;
• contains material that discloses your personal information; or

All intellectual property rights in the Goods, Website and other materials created by us will vest absolutely and automatically on creation, and remain thereafter, in us. You must not reproduce, store, adapt, distribute, display, publish, or create similar works from them.

Upon the purchase of Goods from us, you will own the Goods and have the right to display and use it. You will not have the right to reproduce or authorise a third-party to reproduce the Goods.

PROHIBITED USE
